論我國(guó)數(shù)據(jù)資源開發(fā)利用的立法完善

摘要： 我國(guó)積極探索推進(jìn)數(shù)據(jù)要素市場(chǎng)化，加快構(gòu)建以數(shù)據(jù)為關(guān)鍵要素的數(shù)字經(jīng)濟(jì)，圍繞數(shù)據(jù)資源開發(fā)利用的法律制度體系建設(shè)取得了積極進(jìn)展，形成了覆蓋關(guān)鍵環(huán)節(jié)的體系框架及關(guān)鍵要求。隨著我國(guó)數(shù)據(jù)要素市場(chǎng)化進(jìn)程進(jìn)一步走深走實(shí)，與國(guó)際數(shù)據(jù)治理規(guī)則競(jìng)爭(zhēng)進(jìn)一步加劇，現(xiàn)有的數(shù)據(jù)資源開發(fā)利用立法在支撐全國(guó)統(tǒng)一數(shù)據(jù)市場(chǎng)建設(shè)，以及引導(dǎo)、規(guī)范開發(fā)利用活動(dòng)方面存在不足，應(yīng)在數(shù)據(jù)基礎(chǔ)設(shè)施、數(shù)據(jù)供給、數(shù)據(jù)流通、數(shù)據(jù)應(yīng)用創(chuàng)新及數(shù)據(jù)跨境流動(dòng)等關(guān)鍵環(huán)節(jié)進(jìn)行立法完善。

Study on the improvement of legislation for development and utilization of data resources

Abstract： China actively promotes the marketization of data elements and accelerates the construction of a digital economy with data as the key element. A preliminary legal system has been established for the development and utilization of data resources. This legal system covers key data links and proposes key requirements. With the development of the data element market, China participates in the international competition of of data rules. However, the existing data legal system cannot support the development and utilization of data and is also insufficient to meet the development of a unified national data market. Based on the theoretical research and practical needs, this study concludes with proposals to solve the improvement of legislation problems of data infrastructure, data supply, data circulation, data application and innovation, data crossborder flow.

0 引言
隨著我國(guó)數(shù)據(jù)要素市場(chǎng)化進(jìn)程進(jìn)一步走深走實(shí)，與國(guó)際數(shù)據(jù)治理競(jìng)爭(zhēng)進(jìn)一步加劇，建立健全數(shù)據(jù)立法成為破解數(shù)據(jù)要素市場(chǎng)發(fā)展存在問題、搶占國(guó)際數(shù)據(jù)規(guī)則話語(yǔ)權(quán)的必然選擇。我國(guó)現(xiàn)有的數(shù)據(jù)資源開發(fā)利用立法在要求細(xì)化程度、規(guī)則統(tǒng)一程度等方面存在不足，需在數(shù)據(jù)基礎(chǔ)設(shè)施、數(shù)據(jù)供給、數(shù)據(jù)流通、數(shù)據(jù)應(yīng)用創(chuàng)新及數(shù)據(jù)跨境流動(dòng)等關(guān)鍵環(huán)節(jié)進(jìn)行補(bǔ)充完善，以更好地支撐全國(guó)統(tǒng)一數(shù)據(jù)市場(chǎng)建設(shè)，更有力地引導(dǎo)和規(guī)范數(shù)據(jù)資源開發(fā)利用活動(dòng)。
